The laws of the Republic of India shall apply and the Courts in Mumbai in exclusion of any other courts shall have jurisdiction in respect of all the terms, conditions and disclaimers. Goalsquad.com reserves the right to make changes, amendment, addition or deletion to the website and the terms, conditions and disclaimers at any time and without notice to you customers/users of the services/website of goalsquad.com.

DEFINITIONS

“Agreement” means the terms and conditions as detailed herein including all schedules, appendices, annexures, privacy policy, and will include the references to this agreement as amended, negated, supplemented, varied or replaced from time to time.

” GoalSquad.com ” / ” GoalSquad ” / “website ” means the online shopping platform and the services provided by it and its affiliates owned and operated by Samer Exim Private Limited which provides a venue / platform to the Users of GoalSquad to buy the products listed on goalsquad.com.

We are not responsible for typographical errors.

Disclaimer of warranties and limitation of liability

GoalSquad has made this service available to use as a matter of convenience. GoalSquad also disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. GoalSquad does not warrant that this site, its servers, or e-mail sent from GoalSquad are free of viruses or other harmful components. GoalSquad will not be liable for any damages of any kind arising from the use of this site, including, but not limited to direct, indirect, exemplary, incidental, punitive, and consequential damages.

GoalSquad does not endorse in anyway any advertisers/ contents of advertisers on its web pages or other communication.

GoalSquad will not be responsible for any damage suffered by you/Users from use of the services on this site. This without limitation includes loss of revenue/data resulting from delays, non-deliveries, missed deliveries, or service interruptions as may occur because of any act / omission of the vendor. This disclaimer of liability also applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action.

You/User agrees and acknowledges that you/User shall be solely responsible for your/User’s conduct and that GoalSquad reserves the right to terminate your rights to use the service immediately, notwithstanding penal provisions under the Indian cyber laws or any other allied laws enacted by the government of India or any other statutory, legislative or regulatory authority authorized in this regard from time to time. In no event shall GoalSquad, its affiliates, employees, agents, consultants, contracted companies be liable for any direct, indirect, punitive, incidental, special or consequential damages or for any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the GoalSquad sites/services for interrupted communications, delay, lost data or lost profits arising out of or in connection with this agreement.

GoalSquad therefore neither endorses nor offers any judgment or warranty and accepts no responsibility or liability for the authenticity/availability of any of the goods/services/or for any damage, loss or harm, direct or consequential or any violation of local or international laws that may be incurred by your visit and/or transaction/s on these sites.

GoalSquad shall not be liable for any delay / non-delivery of purchased goods, due to flood, fire, wars, acts of God or any cause that is beyond the control of GoalSquad.

All prices, unless indicated otherwise are in Indian Rupees. The availability of products is subject to change without prior notice at the sole discretion of GoalSquad and orders can be cancelled if the product goes out of stock.

GoalSquad reserves the right to refuse or cancel any order placed for a product that is listed at an incorrect price which may be higher or lower than published. This shall be regardless of whether the order has been confirmed and/or payment been levied via credit card or cheque or otherwise. In the event the payment has been processed by GoalSquad the refund amount shall be credited to your credit card account and duly notified to you by email or sent by cheque.

In a credit/debit card transaction, you must use a credit /debit card that is issued in the name of the User. GoalSquad will not be liable for any credit/debit card fraud because of the card being used fraudulently. The liability to use a credit/debit card or a net banking transaction fraudulently will be on the User and the onus to ‘prove otherwise’ shall be exclusively on the User.

Any request for cancellation of orders once duly placed on the site, shall not be entertained.

In the event that a non-delivery occurs on account of a mistake by you (i.e. wrong name or address) any extra cost incurred by GoalSquad for re-delivery shall be claimed from the User placing the order.

All products are duly screened and assured by GoalSquad to ensure that the products are of the standard, quality, composition, style or model that they represent. All and any additional information/description, etc. for a product that is displayed/showcased on GoalSquad is on behalf of the publishers/hardware manufacturers and is as provided to GoalSquad. GoalSquad does not take any responsibility for any incorrect or error in the display/showcase of such information.

Presently, the service(s) of GoalSquad Shopping are being offered free above Rs 1000. However, GoalSquad reserves the right to charge a fee for any or such facilities or freight or handling charges or shipping charges or statutory taxes. GoalSquad and its affiliates reserve the right to cancel orders for the product in their sole discretion for any reason which can include but not limited to, the product being out of stock, or for any other reason without intimation to the User.

CANCELLATION & REFUND POLICY

Any request for cancellation of orders once duly placed on the site, shall not be entertained. GoalSquad provides refund only in case of faulty and damaged software and hardware subject to the packaging and casing being returned in good condition.

In case of Product: Faulty and damaged products/cases must be returned within 14 days from the dispatch date. We do not cover faults caused by accident, neglect or misuse.

Please note that you have enclosed all the original tags, badges, plastic wrap, box, wrench, etc. that arrived with your merchandise?

If technical problems prevent or unreasonably delay delivery of the product, your exclusive and sole remedy is either replacement or refund of the price paid, as determined by us.

The refund will be processed for the cancelled Order through the same mode of payment Eg: If the payment is made through Credit Card and the status is marked as cancelled, the amount would be refunded to the credit card’s account.

For Credit card/Debit card mode of payment, refund processing time is 6-8 working days. For COD/cheque/DD mode of payment, refund-processing time is 15-20 working days. Cheque will be made as per Billing Name provided.

For items that were not delivered, refund will be processed only on confirmation that the product was not delivered to you and you choose to take a refund and are not interested in any other product.

For orders placed through gift certificates, refund would be provided in form of a new gift certificate for the same value.

GoalSquad has partnered with one of India’s leading Payment Gateway – CCavenue for our online payments through Credit Card, Debit Card and Net Banking. We accept Visa, MasterCard, American Express & Diner’s Club cards. We also provide

COD(Cash On Delivery) option to our customers.

SECURITY POLICY

VISA and MasterCard payments are processed through an online payment gateway system. You need not worry about your credit card information falling into the wrong hands because your bank will authorize the credit card transaction directly without any information passing through us. In approximately 25-30 seconds (depending on your internet connection) your bank will issue via the online payment gateway an authorization code and confirmation of completion of transactions.

COD POLICY

At the time of delivery please hand over the CASH against delivery of the product. The product will be delivered in a sealed condition. Please DO NOT accept any packet which is appears to be tampered or damaged externally.

Kindly note that option of Cash on Delivery is available only for certain pin codes and on certain products.

BILLING & SHIPPING DETAILS

Please take extra care while filling your Billing Details and Contact Information. Your Name and Address should be exactly as it appears on your Credit Card/Debit Card statement. Your Contact information should be verifiable by your Bank/ Credit Card provider in authorizing payment.

Please take care that your Billing Details and your Name and Address exactly as they appear on your Credit Card/Debit Card statement and contact information that your bank or Credit Card provider/Bank may verify in authorizing payment.

Your contact information also helps us to send you order confirmation and update you at all times about your order. Shipping Details are the delivery name, address and contact details where you would like your order delivered. If your Billing and Shipping details are the same, simply click the box provided. Billing Address & Shipping Adress could be different. Please make sure to fill in the right one at the right place.

PRE-ORDERS

By pre-ordering products, you are authorizing GoalSquad to automatically charge your account and deliver or download the product when it becomes available. You may cancel your pre-order prior to the time the item becomes available.

We provide pre-order price guarantee on certain products only. What this means that even if the price rises you will have to pay the same amount at which you booked your pre-order. However, in case there is a fall in price by release date, you will have to pay the lower price . Pre-order price guarantee will only be applicable on products where pre-order price guarantee is specifically mentioned in the product description.

Pre-order price guarantee is only applicable on pre-orders.

In case the pre-ordered product does not fall under pre-order price guarantee, you will liable to pay as per the amount billed which will be the price at which the product is released in India

TRADEMARKS

The logo / image of GoalSquad on the home page of the website & other pages and as used in the communication to the User is registered by GoalSquad and cannot be used or communicated or distributed without the specific and written permission of GoalSquad.

LICENSE AND SITE ACCESS

GoalSquad grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except in case GoalSquad gives written consent for the same. GoalSquad and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

SUSPENSION DUE TO NON-COMPLIANCE WITH AGREEMENT

Notwithstanding other legal remedies that may be available to GoalSquad, GoalSquad may in its sole discretion limit user activity by immediately removing user listing either temporarily or indefinitely or suspend or terminate user membership, and/or refuse to provide user with access to the site if:

The user is in breach any of the terms and conditions of this agreement and/or the terms and conditions of usage of GoalSquad
The user has provided wrong, inaccurate, incomplete or incorrect information.
Your actions may cause any harm, damage or loss to the other Users or GoalSquad.
Illegal and/or unauthorized use of the service, including unauthorized framing of or linking to the GoalSquad site will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal and injunctive redress.

RISK OF LOSS

All items purchased from GoalSquad are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon the delivery to the carrier by the vendor/merchant/affiliate/manufacturer.

PRODUCT DESCRIPTION

GoalSquad and its affiliates attempt to be as accurate as possible. However, GoalSquad does not warrant that product descriptions or other content or prices/amounts of this site is accurate, complete, reliable, current, or error-free. If a product offered by GoalSquad itself is not as described, your sole remedy is to return it in unused condition.

FORCE MAJEURE
